Los Alamos DWI Suspect Enters Innocent Plea By Jeremy Pawloski Journal Staff Writer A Los Alamos man accused in the drunken-driving deaths of two women who were walking with a baby in a stroller faces a maximum 28-year prison sentence if convicted, 1st Judicial District Attorney Henry Valdez said Monday. John G. Martinez, 41, was arraigned Monday before District Judge Stephen Pfeffer on two counts each of vehicular homicide and aggravated driving while intoxicated. Martinezs attorney Sydney West entered a not-guilty plea on his behalf. Martinez is charged in the deaths of Xuming Wu, 40, and Jing Xuan Shi, 36, who were killed June 1 while walking in Los Alamos with Shis baby in a stroller. Shis 6-month-old son, Alfred Chen, suffered a skull fracture and other injuries in the crash, but was recovering, his father, Xian Chen, has said. He could not be reached for comment Monday. Martinez, who has four DWI charges stretching back to 1978, blew a .27 and a .28 percent blood-alcohol level - more than three times the legal limit - on alcohol breath tests after the crash. Martinez told Pfeffer he has lost his job at a grocery store in the wake of the crash. Valdez argued against reducing Martinezs $1 million bond, because of his prior DWIs and statements he made to police after his arrest when he used a racial epithet to describe his victims. West said "$1 million bond is tantamount to no bond." Pfeffer reset bond to a $100,000 property or surety bond, and said Martinez must agree to submit to electronic monitoring if he is released. West said after the hearing that Martinez may have difficulty submitting to electronic monitoring in Los Alamos because the service is not available through the jail there. |
